Competition Terms and Conditions

The promoter: CHANGE YOUR LUCK LTD trading as “CHANGE YOUR LUCK” and will be known in this document as the promoter hereafter

The competition

2.1 These terms and conditions are applicable to any and all competitions run by the promoter, and all competitions listed on the promoters website at https://www.changeyourluck.co.uk/ 

(the “website” hereafter)

 

2.2 All competitions are skill based competitions. An entry fee is payable each time you enter into a competition with the promoter. A free entry route is available, see below in “Entry methods” for details.

2.3 Everyone who wishes to enter a competition (an “Entrant”) is required to pass a test of skill to be in with a chance of winning. This test of skill is a question which must be correctly answered (the “Competition Question”) and this question will be set by the Promoter.

Entry Methods.

3.1 Competitions will be run from and to the opening and closing dates (dates inclusive) specified on the Website and will be known respectively as the “Opening Date” and “Closing Date” on each competition. All times and dates are set in reference to the time in the city of London England.

3.2 The Promoter reserves the right to change the Opening and Closing Dates of any competition if it is found by the Promoter to be necessary to do so. In the event the promoter does change these dates, the Website will display this change of information when it is made. 

3.3 All competition Entries must be received by the promoter no later than the time specified on the Closing Date. Any competition entries received after this time are automatic disqualifications and will receive no refund. 

3.4 There are limited tickets available to each competition. This limit will be clearly displayed per competition. There may be a limit to how many entries you can make. If the maximum number of entries is reached the competition will close early.

3.5 ENTER THE COMPETITION BY:

  • Go to the website

  • Go to the competition you wish to enter

  • View the competition question

  • Complete AND SUBMIT the online entry form (the question, by adding your answer to the question to the basket/cart)

  • Purchase the required number of entries by paying for the items in your basket/cart

  • Once your entries are purchased, if you answered the question correctly you will be entered into the competition

3.6 ALL entries must be in the English language and this English must be legible and recognisable as English. Any illegible entries or entries in languages other than English will be disqualified and no refund will be given.

3.7 Confirmation from the promoter will be sent stating your entry has been received and confirming if your answer to the Competition Question is correct. Entries with incorrect question answers will not be admitted to the competition. Incorrect answers will not receive any type of refund.

3.8 Competition Entries that are not successfully completed are not the responsibility of the Promoter and the Promoter accepts no responsibility for such entries. These include entries that are lost or destroyed regardless of cause. This includes but is not limited to entries lost or destroyed due to equipment failure or technical malfunction, systems failure, satellite, network, server, computer hardware or software failure of any kind.

3.9 You are entering into a contract with the Promoter and are agreeing to be bound by these terms and conditions by Purchasing entries and submitting competition entries of any kind.

3.10 By complying with the following conditions, you may enter a competition for free:

  1. Sending your address by FIRST CLASS POST ROYAL MAIL on a postcard (unenclosed) to the Promoters address: MAIL ADDRESS  6 Margaret Street, Newry, County Down, United Kingdom, BT34 1DF
     

  2. THE ENTRY MUST INCLUDE THE FOLLOWING INFORMATION:
     

  • Your full name (first last and middle if applicable)
     

  • Your address and date of birth
     

  • Contact details - your email address AND telephone number.
     

  • Name of the competition you wish to enter
     

  • Your answer to the Competition Question.

 

  1. Incomplete or Illegible entries will be disqualified.
     

  2. Entries may be made by you to any competition (Up to limits placed on entries to each separate competition by the Promoter) via the free entry route. However each free entry via this route must be submitted and posted to the Promoter separately on an unenclosed postcard. Bulk entries (entries in one large envelope, tied together or otherwise packaged so only one stamp is used or one postage charge incurred) will not be accepted as multiple entries. If a bulk entry is received it will be treated and counted as a single entry.
     

  3. By entering any competition, you confirm you are eligible to enter that competition. You must state on the Postal entry that you accept these terms and conditions.
     

  4. The Promoter must receive your entry at least two days before the closing date. Entries received after the closing date or within 48 hours until the closing date will not be entered into the random draw.
     

  5. Receipt of your entry will not be given by the Promoter. The Promoter will not confirm if your competition question answer is correct.
     

  6. All postal entries are processed each day at 5pm. If the number of paid entries reaches the cap or limit set for that competition before your free entry is received or processed, you will not be entered into the random draw.
     

  7. Entrants MUST have an account on our website that is verified and active at the time the postal entries are processed. The details on the postcard MUST match the name and address on the account to which they are to be connected and added. Entries that do not meet these requirements will be discarded as they are not valid for entry.
     

  8. All entries are required to be handwritten. Computer, machine or other means of mass producing entries (such as ink stamps) will not be accepted or entered.

Choosing the winner

4.1 All entrants who correctly answered the competition Question are placed in a draw for that competition and the winner is chosen via random selection, a random draw. These random draws take place as soon as reasonably possible, and at an upper limit of 7 days of the Closing Date. (this date is known as the Draw Date.)

4.3 Distribution of Tickets - Tickets for each Competition will be distributed once The Competition has closed. Tickets will then be distributed by email.

Eligibility

5.1 The competition is only open to all residents of the United Kingdom and the Republic Of Ireland aged 18 years or over, Except:

  1. Employees of the promoter
     

  2. Employees of Suppliers of the Promoters, Employees of Agents of the promoter, Those professionally connected with the competition or it’s administration or
     

  3. Members of the immediate families or households of a) and b) above or
     

  4. Members of the immediate family of the Promoter

5.2 By entering into the competition you confirm your eligibility to do so. You confirm you are Eligible to claim any prize you may win. The Promoter may require you to provide proof that you are eligible to enter into any competitions the promoter is responsible for. You may be disqualified from the competition if you fail to provide any such proof of eligibility to enter - or any other such information - that the promoter requires within a reasonable time frame.

5.3 Entries will not be accepted by the Promoter if they are:

  1. Automatically generated by a computer or
     

  2. Incomplete

5.4 All rights are reserved by the Promoter to disqualify you if your conduct is considered contrary to the spirit or intention of the prize competition.

5.5 THERE ARE NO refunds of the entry fee for the event under any circumstances, including;

  1. If you find, after entering into the competition, that you are not eligible to enter the competition or claim the prize;
     

  2. If you find, after you have entered into the competition the eligibility criteria for entering into that competition or for claiming the prize changes and you are therefore no longer eligible; or
     

  3. If you are disqualified by the promoter from the competition for any reason.
     

5.6 Until the maximum number of entrants or entries has been reached, entrants can enter the competition as many times as they wish. Entrants submitting an entry via the free entry route must submit each entry separately as detailed above. Bulk entries, should any be received, will not be accepted and will only count as one single (1) entry.

The Prize

6.1 The Prize for each competition is described on the dedicated page for each competition on the Website (the “Prize”). Details are, to the best belief and knowledge of the Promoter, correct as at the Opening Date.

6.2 The promoter reserves the right to substitute the prize with a prize of equal or greater value. Prizes are subject to availability. If any details of the prize change, the Promoter will aim to update the Website as soon as reasonably possible. 

6.3 There are no representations or warranties made or given by the Promoter on or about the prize, the prizes value, its condition or any other information provided on the website. The Promoter makes no representations and gives no warranties that the information provided on the website is complete, accurate or up to date.

6.4 The prize may, in some cases, be provided by a third-party supplier (the “Supplier”). Details of the Supplier (if applicable) will be provided on the Website.

6.5 The Prize has no cash alternative unless clearly stated by the Promoter.

6.6 A discretionary cash alternative can be offered by the promoter for any prize if they wish to do so. This is only if the winner deems it acceptable.

Winners

7.1 The decision of the Promoter is Final. No correspondence will be entered into by the Promoter. No discussions will be entered into by the Promoter.

7.2 The Promoter will, as soon as practical after the Draw Date, Contact the winner personally. Using either the telephone number or email address provided with the competition entry. In the case that the Winner can not be contacted, is unavailable, or has not claimed the prize within 14 days of the Draw Date, the Promoter reserves the right to offer the Prize to the next eligible entrant, who will be selected from the correct entries that were received before the Closing Date. 

7.3 The Promoter must either:
- Publish or make available information that indicates properly that a valid award took place. To comply with this obligation anyone who writes to the Promoter at the address set out in Clause 1 (enclosing with the request a self-addressed envelope so the response can be returned, packaging and delivery for the response paid for by the person making the request) within one month of the Closing Date of the competition will receive a letter stating the Surname and County of Major Prize winners.

7.4 In the event you find your surname, county and winning entry being Published or made available to be objectionable, please contact the Promoter in writing at 6 Margaret Street, Newry, County Down, United Kingdom, BT34 1DF with receipt of Objection having to be at least two days prior to the Closing Date so we are aware of this Objection. In these circumstances where an objection has been made known to us, The Promoter must still provide the information to the Advertising Standards Authority on request.
On the outside front of the letter please indicate “Objection”.

How to claim your prize

8.1 Details are published on the Website on how the prize will be awarded to you and if this will require delivery of the prize to you or if it will be made available for collection.

8.2 If any of your Personal Details change at any time, including your contact information, you should notify the Promoter as soon as reasonably possible. Notification of these changes should be sent to EMAIL ADDRESS contact.change.your.luck@gmail.com. Details that must be included in this notification are:

  • The competition you have entered

  • Your old details

  • Your new details

If your details have changed within 10 Days of the Closing Date, the Promoter will use your old details in the event it needs to contact you.

8.3 Any Cash Prizes will be directly transferred to the bank account nominated by the Winner. Evidence must be provided by the winner that they are the sole or joint beneficiary of the nominated bank account.
Failure to provide this evidence within 14 days will result in disqualification from the competition as well as automatic forfeiting of the prize. In such circumstances The right to offer the prize to the next eligible Entrant selected from the correct entries that were received before the closing date of the competition is reserved by the Promoter.

8.4 There is no responsibility accepted by the Promoter if you are unable to or do not take up the Prize. The Promoter is not liable to pay any compensation if you are unable to or do not take up the Prize.

8.4 The Promoter does not accept any responsibility and is not liable to pay any compensation if you are unable to or do not take up the prize.

Limitation of Liability

The promoter, The promoters agents or distributors insofar as is permitted by law will not be responsible in any circumstances to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize, excepting where it is caused by the Promoters Negligence, the agents or distributors of the promoters negligence, or that of the employees of the promoter and the promoters agents and distributors. Your statutory rights are not affected.

Publicity and Data Protection

10.1 By entering into the competition you agree that any personal information provided with the competition entry to the promoter by you may be held and used only by the Promoter or the Promoters agents and suppliers to administer the competition or as set out otherwise in the promoters privacy policy, a copy of which is available on the Website.

10.2 In the event you are the winner of the competition, you agree to the Promoter using your name, town, image and country of residence in the announcement of the winner to announce the competition winner. Additionally you further agree to participate in any reasonable publicity required by the promoter.

10.3 In the event you do not wish to participate in any publicity, you must notify the promoter prior to the Competitions Closing Date. This will not affect your chances of winning the Prize. We may still provide your details to the Advertising Standards Authority if you do not agree to participate in any publicity regarding the competition. This is a legal requirement we MUST comply with, to prove the competition has been properly administered and the Prize awarded.

10.4 If you are the winner of the competition, The Promoter may require you to provide further proof of your identity and additional personal information in order to confirm your eligibility to claim the prize and transfer ownership of the prize to you. You consent to your information being used in this way. You are entitled to request further details about how your personal information is being used. You are entitled to withdraw your consent to your personal information being used in this way, however withdrawing your consent to this process may prevent the prize being transferred to you. In these circumstances of withdrawing your consent to your information being used you will be considered to have withdrawn from the competition and forfeit the prize. The Promoter reserves the right in such a case to offer the Prize to the next eligible entrant, who will be selected from the correct entries that were received before the Closing Date. 

10.5 Please be aware that under data protection laws you are entitled to request that the promoter not contact you and removes your details from its database. Please recognise that if you make such a request you will be withdrawing yourself from the competition without any refund or exchange as it will not be possible to contact you in the event that you are the winner of said competition. If you wish for the Promoter NOT to use any of your personal details for promotional purposes please email the promoter at EMAIL ADDRESS contact.change.your.luck@gmail.com PRIOR to the Closing Date. 

General

11.1 The Promoter reserves the right to amend the Terms and conditions laid out here from time to time. The latest version of these terms and conditions will be available on the Website. 

11.2 If there is, at any time, any reason to believe that there has been a breach of these terms and conditions by you, then the Promoter reserves the right to, at its sole discretion, exclude you from participating in the competition and in any future competition. 

11.3 The Promoter reserves the right to, where it may become necessary to do so, hold, void, suspend, cancel, or amend the prize competition.

11.4 The competitions on the website are, in no way, sponsored, endorsed, administered by or associated with the sites or service providers they are streamed or advertised on. Entrants agree, by entering the competition, that the streaming services we use and advertising services we use have no liability and no responsibility for the administration or promotion of the competition.

11.5 These terms and conditions shall be governed by English law. The parties submit to the exclusive jurisdiction of the courts of England and Wales. 

11.6 It is advised that you print and keep a copy of these terms and conditions for your records.
